1. The present writ petition has been filed inter-alia with the prayer to quash the order dated 27.04.2023 passed by the respondent no.3 namely Chief Administrative Officer, Directorate of Plant Protection, Quarantine & Storage, NH IV, Haryana, Faridabad to issue appointment and joining letter to the petitioner in pursuance of his selection on the post of Scientific Assistant in the Directorate of Plant Protection, Quarantine & Storage - Cancellation of candidature for the post of Scientific Assistant.
2. Heard counsel for the petitioner and Shri Rajesh Kumar Vidyarthi, learned counsel for the Union of India.
3. As the matter pertains to a post under the Central Government as such this Court does not have jurisdiction to entertain and decide the petition keeping in the view the judgment of the Apex Court in the case of L. Chandra Kumar vs. Union of India and others reported in AIR 1997 SC 1125 as the court of first instance is the Central Administrative Tribunal.
4. Accordingly, keeping in view the law laid down by the Constitution Bench of the Apex Court in the case of L. Chandra Kumar (supra), the writ petition is disposed of leaving it open to the petitioner to approach the Central Administrative Tribunal for any of their grievances.
