Sri Tushar Gupta, Advocate holding brief of Sri Pankaj Gupta, learned counsel for the Gaon Sabha raised preliminary objection regarding maintainability of present petition on the ground that the petition on behalf of petitioner, who is a Pradhan, is not maintainable. It is in view of the judgment passed by the Division Bench of this Court in Writ Petition No. 2737 (M/B) of 1994 (Babu Ram Verma vs. Sub Divisional Officer, Akbarpur, District-Faizabad & Others). Reliance has also been placed on the judgment passed in Writ - C No. 6330 of 2022 (Devendra Singh vs. State of U.P. & 4 Others).
The aforesaid submission has not been disputed by the learned counsel for the petitioner.
In view of aforesaid including the judgment(s) referred above, this Court finds force in the submission of the learned counsel for the Gaon Sabha. Accordingly, the petition is dismissed.
