The present appeal has been filed by the appellant Hari Pal against the judgment and order dated 14.05.1992 passed by Special Sessions Judge, Budaun in Sessions Trial No. 123 of 1991, Police Station Dataganj, District Budaun.
As per office report dated 07.12.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 15.09.2022 informed that the appellant - Hari Pal has died 28 years ago. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.
Accordingly, the appeal stands abated.
Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
