Heard learned counsel for the parties and perused the material on record of this appeal.
This appeal has been preferred by appellant- State against the judgment and order dated 10.8.1992 passed by Special Judge, Unnao in S.T. No.16 of 1991, under Sections 498 (A), 304(B) IPC and u/s 3/4 D.P. Act, Police Station- Barasagwar, District Unnao.
From perusal of the report of the Chief Judicial Magistrate, Unnao dated 19.07.2021 which is on record of this appeal, it transpires that the appellants in this appeal- Sateyendra Kumar Singh, Manoj Kumar Singh, Sankatha Singh and Smt. Ram Pati have died.
Learned A.G.A. has submitted that in view of the report of Chief Judicial Magistrate, Unnao, this appeal is liable to be abated.
In view of the submission made by learned A.G.A and on perusal of the recitals contained in report of Chief Judicial Magistrate, Unnao, this appeal is dismissed as abated.
