Heard learned counsel for the petitioner. Notice on behalf of the respondent nos. 1 to 4 has been accepted by the office of the Chief Standing Counsel.
Submission of learned counsel for the petitioner is that the petitioner has been denied the benefit of payment of post retiral benefits in respect of the service rendered by him.
It is submitted that case of the petitioner is squarely covered by the Judgment and order dated 06-08-2021 passed in Writ A No. 9030 of 2021, Awadhesh Kumar Singh Versus State of U.P. and Judgment and order dated 22-09-2021 passed in Writ Petition No. 18031(S/S) of 2021, Dr. Prakash Veer Singh Versus State of U.P. Thru. Prin Secy. Ayush Anubhag & Ors.
Per contra, learned Standing Counsel submits that in other writ petitions, wherein similar issue has been raised, this court has called for the Counter Affidavits.
Considering the aforesaid fact, let Counter Affidavit be filed by the state within two weeks informing as to whether the case of the petitioner is squarely covered by the case of Awadhesh Kumar Singh (Supra) and Dr. Prakash Veer Singh(Supra) or not.
The petitioner, thereafter, shall have one week time to file Rejoinder Affidavit.
List this case on 06-12-2021, as fresh.
