This writ petition has been filed with a prayer to quash the impugned order dated 15.4.2017 ( Annexure-4 to the writ petition) issued by the respondent No.5 whereby the petitioner has been removed from the post of Joint Secretary of the Karm Chari Parisad in Diesel Locomotive Work Varanasi as also against letter dated 15.4.2017 (Annexure-6 to the writ petition) issued by the respondent No.4 by which respondent No.6 has been declared as Joint Secretary of the Karm Chari Parisad in Diesel Locomotive Works Varanasi.
Purely factual issue with regard to the correctness of resolution of no confidence passed against the petitioner in the emergent meeting held on 13.4.2017 dated 15.4.2017 have been raised. It is not proper for this Court to decide such issue of fact at the first instance.
In our opinion, petitioner must seek his remedy by filing a civil suit where evidence oral and documentary can be examined.
The writ petition is disposed of.
