In the afore-captioned contempt petition, petitioner has moved an application for summoning the opposite party stating therein that although the opposite party in order to show that the compliance of the court's order has been done by ordering payment of revised salary w.e.f. the date of order but the opposite party after passing the order has stopped the salary of the petitioner and the petitioner has not even paid a single penny after the order dated 5.5.2015. Further the order of the writ court has not been complied with in its letter and spirit as the disparity which has been indicated and brought to the notice of the Court is still existing inasmuch as the petitioner has not been paid salary w.e.f. the date his counter part part Sri Vishwajit Rai is being paid the revised salary with effect from September, 2014 whereas the direction has been issued for paying the  emoluments from the date of order dated 5.5.2015.

Appreciating the submissions of the petitioner's Counsel, prima-facie, this Court is of the view that the act of the opposite party is highly contumacious and the petitioner cannot be treated differently.

List this case on 26.10.2015. If the corrected and modified order is not issued,the  opposite party will appear on the date fixed.
