Heard Sri Prabhat Kumar Singh, learned counsel for the applicant and Sri R. K. Maurya, learned A.G.A. appearing for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed for quashing the order dated 04.09.2015, passed by the learned Upper Sessions Judge / Special Judge (E.C. Act), Etawah, in Sessions Trial No. 462 of 2008 (State VS. Sarvendra), under Section 302 IPC, Police Station Bharathana, District Ewawah, arising out of FIR dated 05.09.2005, registered as Case Crime No. 197 of 2005, under Sections 147, 148, 149, 302, 307, 427, 452, IPC and 7 Criminal Law Amendment Act. He further prayed for direction to the court below to recall the witness Ajit Singh (P.W.-1), to be cross examine. He further prayed for stay the further proceeding of the aforesaid case.
After having heard the learned counsel for the parties present and perused the impugned order as well as the material brought on record, I am of the view that the impugned order is based upon relevant considerations and supported by cogent reasons, hence requires no interference by this Court.
The application lacks merits and is accordingly dismissed.
