Heard Sri Arun K. Singh-I, learned counsel for the applicant, and Sri R. K. Maurya, learned A.G.A. appearing for the State, and perused the record.

This application has been filed with prayer to grant three weeks further time to the applicant to appear before the court below, in pursuance of the order dated 24.07.2015 passed by this Court.

It is submitted by the learned counsel for the applicant that aggrieved by the order dated 24.07.2015 passed by this Court, the applicant has preferred a SLP (Crl.) No. 7362 of 2015 (Geeta Dixit Vs.State of U.P. and another), before the Hon'ble Apex Court, which was dismissed by Hon'ble Apex Court vide order on 11.09.2015. A copy of order dated 11.09.2015 is filed herewith and marked as annexure no. 2 to the affidavit.

He submitted that the time which was granted by this Court vide order dated 24.07.2015 for surrendering before the court below was expired, as he has challenged the same before the Hon'ble Apex Court, and that too has been dismissed. Due to which the applicant could not surrender before the court below within time. He prays that some further time may be allowed to the applicant to surrender before the court below in compliance of the order dated 24.07.2015 passed by this Court. He further submitted that applicant is aged about 66 years and facing old age ailment, and some medical documents of the applicant have also been annexed.

Considering the fact and circumstance of the case, the applicant is allowed 10 days and no more time to surrender before the court below, in compliance of the order dated 24.07.2015 passed by this Court.

With the aforesaid observation the present application is disposed of finally.

The office shall provide a certified copy of this order to the learned counsel for the applicant within 24 hours.
