Heard learned counsel for the parties.
On behalf of the Public Service Commission, a supplementary affidavit has been field stating therein that the petitioner has not been selected as he could not achieve the minimum cut of 30 per cent marks during interview. Fixation of 30 per cent marks as the minimum cut of marks in respect of SC/ST candidate for selection, which was satis basis of selection to had been fixed in the extraordinary meeting of the Commission on 5.2.2011. Copy of the same has been annexed as Annexure-1 to the counter affidavit.
In view of the aforesaid, we are of the considered opinion that if the writ petitioner has any grievance, he may approach the respondent no.2-Secreatry, Public Service Commission at the first instance.
Accordingly, this writ petition is disposed of with liberty to the petitioner to file a representation for ventilating his grievances before respondent no.2 within two weeks along with a certified copy of this order. If such representation is filed, respondent no.2 shall consider the same by means of a reasoned order preferably within eight weeks thereafter. All consequential actions shall be taken accordingly.
