Heard learned counsel for the parties.
The Election Commissioner under the order impugned dated 27.8.2015, returned a finding recorded that the complain of the petitioner by recording a finding that the dispute with regard to constitution of Committee of Management relates to a period prior to the constitution of the Election Commission for the Recovery Society and, therefore, is not maintainable.
Without entering into the correctness or otherwise of the orders passed by the Election Tribunal, we are of the opinion that petitioner has the remedy of approaching the Registrar, Recovery Societies under Section 128 of the U.P. Recovery Societies Act, 1965 at the first instance.
Writ petition is dismissed with liberty to the petitioner to seek his remedy accordingly.
