Hon'ble Arun Tandon,J.

Hon'ble Ashwani Kumar Mishra,J.

Heard learned counsel for the parties and perused the record.

The application made by the petitioner for being considered for allotment of dealership of Kisan Seva Kendra was rejected by the Indian Oil Corporation vide orders dated 3.2.2010. Not being satisfied with the order rejecting the candidature for dealership of Kisan Seva Kendra, he filed a representation before the Indian Oil Corporation as per the order dated 9.3.2010 passed by a Division Bench of this Court in earlier petition being Writ No. 10436 of 2010 filed by the petitioner. The representation made by the petitioner came to be rejected vide order dated 20.8.2010 passed by Indian Oil Corporation. The reason disclosed for rejecting the candidature of the petitioner was that the relationship affidavit as submitted along with the application was not as per Annexure-A to the application form.

The orders are being challenged by means of the present writ petition after more than five and half years. The only explanation furnished before this Court is that in respect of another candidate belonging to reserved category, the Indian Oil Corporation had permitted the submission or the affidavit of consent of the co-owner of the land afresh.

In our opinion, this writ petition filed after five years of the date of  orders passed by the Indian Oil Corporation in the year 2010, it need not be entertained more so when it has not been explained as to what has happened during all these five years.

The writ petition is accordingly dismissed.
