Heard learned counsel for the parties and perused the record.
Petitioner to issue a writ order or direction in the nature of certiorari for quashing the notice dated 2.9.2015 issued by the respondent-bank.
We are of the considered opinion that proper remedy available to the petitioner is to approach the Tribunal under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Act, 2002.
Writ petition is dismissed with liberty to the petitioner to seek his remedy accordingly.
