Heard learned counsel for the parties and perused the record.
With regards to the prayer of the refund of Rs. 70,000/- said to have been provided as scholarship to the appellant by the State Government, it has been recorded by the Hon'ble Single Judge that the appellant has failed to lead any evidence worth consideration in support of his pleadings that there has been no double payment of Rs. 70,000/-.
We see no reason for interference with the order of Hon'ble Single judge.
So far as prayer no.2 is concerned, we find that Hon'ble Single Judge has recorded cogent reasons for coming to the conclusion that the appellant has failed in the examination concerned. However, if the appellant has any grievance qua the marks awarded, he may approach the Vice Chancellor of the University concerned.
Accordingly, this appeal is disposed of with a liberty to the appellant to file a representation for ventilating his grievances before respondent no.2 (Vice Chancellor) within two weeks along with a certified copy of this order. If such representation is filed, respondent no.2 shall consider the same by means of a reasoned order preferably within eights weeks thereafter. All consequential actions shall be taken accordingly.
