Affidavits of compliance have been filed by the opposite party no.1 and 3.
In the said affidavits it has been averred that in compliance of the order dated 26.8.2014 passed by the writ court, the petitioner has been given notional promotion vide order dated 4.12.2014 and after the financial concurrence and No objection accorded by the State Government, the Assistant Marketing Officer, Gorakhpur has sent the necessary document to the Director, Treasury and Pension for necessary action vide letter dated 22.8.2015. The Pension Directorate, in its turn, has issued the Pension Pay Order dated 4.9.2015 in favour of the petitioner. Therefore, the complete compliance of the order of writ court has been made and the contempt petition is liable to be dismissed.
Counsel for the petitioner after seeing the affidavit and Pension Payment Order dated 4.9.2015 states that as the order of writ court has been complied with, he does not want to press the matter any further.
Accordingly, the contempt petition is dismissed and the notices issued to the contemnors are hereby discharged.
