Heard learned counsel for the parties and perused the record.
It is stated that despite proceeding under Section 95(1) of the U.P.Panchayati Raj Act having been initiated against the Gram Pradhan by the District Magistrate as early on 16.12.2013, no final order has been passed till date. The enquiry report reflects that charges as levelled against the Gram Pradhan were proved.
We need not enter into any of the issue raised by the petitioner at this stage.
The writ petition is disposed of with a direction to the respondent-State to take an appropriate decision and conclude the proceeding initiated under Section 95(1) against the respondent no.5 preferably within a period of four weeks from the date of production of a certified copy of this order strictly in accordance with law.
