Heard learned counsel for the parties and perused the record.
Against the order impugned dated 16.7.2015 passed by respondent no.2- Sub-Divisional Magistrate cancelling the fair price shop, the petitioner has remedy to approach the Commissioner, Bareilly Division, Bareilly.
Considering the facts and circumstances of the case, we provide that the petitioners may seek his remedy before the Commissioner, Bareilly Division, Bareilly at the first instance.
Writ petition is dismissed with liberty to the petitioner to seek his remedy accordingly.
