Heard learned counsel for the parties and perused the record.
The petitioner is stated to have filed a suit under Section 229-B in respect of the property concerned for declaration. It is stated that the recorded tenure holders of the same land may respond to the notice of the Greater Noida Industrial Development Authority for purchase of the property by mutual agreement and may execute the sale deed.
The petitioner has, therefore, approached this Court for quashing the notification dated 20.6.2015 and not to dispossess the petitioner from the property in dispute.
We are of the considered opinion that the writ petition is misconceived. Petitioner is at liberty to seek injunction in pending suit.
The writ petition is dismissed.
