(C.M.Application No. 112769 of 2015) This is an application for restoration of interim order dated 2.12.2002.

Submission of the learned Counsel for the petitioner is that writ petition was dismissed as having become infructuous vide order dated 25.2.2014 in absence of petitioner's counsel. On coming to know about the said order petitioner has filed an application for recall of order along with condonation of delay on 10.7.2015. The order dated 25.2.2014 was recalled vide order dated 17.8.2015, but due to inadvertence, the mention about the continuance of interim order was not made and therefore, the interim order was not restored back. It is also submitted that in pursuance to the interim order dated 2.12.2002, petitioner has been appointed on the post of Village Development Officer, but in the absence of said order petitioner is apprehending that he may be ousted from service.

Learned Standing Counsel has no objection to the prayer of the learned Counsel for the petitioner.

On due consideration, application is allowed. The interim order dated 2.12.2002 is hereby restored.
