Heard learned counsel for the parties and perused the record.
In the facts and circumstances of the case, we are of the considered opinion that serious issues of fact with regard to the demarcation of the property purchased by the petitioner vis a vis plot no.96, which is recorded as in the name of Indrapari wife of Shabhoo Dayal Mishra are involved, writ is not the proper remedy.
The petitioner may file a suit before the competent court seeking appropriate interim protection, as may be advised.
Writ petition is dismissed with liberty to the petitioner to seek his remedy accordingly.
