Sri Pratul Kumar Srivastava, Advocate appearing for the petitioner states the order of Central Government Industrial Tribunal Cum Labour Court, Lucknow, on the preliminary issues is wholly unreasonable and unsustainable as the findings recorded by the Tribunal in the impugned order are contrary. As regard the passing of order of punishment on 21.9.1995, i.e. prior to issuance of show cause notice cannot be faulted in view of the law laid down by the Supreme Court in AIR 1966 SC 1313.

Learned Counsel for the private respondent states that he may be allowed some time to prepare the case. On his request, put up this case on 29.10.2015.
