Learned Standing Counsel has raised a preliminary objection regarding maintainability of the present writ petition on the ground that earlier writ petition filed by the petitioner i.e. writ petition no. 3599 (SS) of 2001:Km. Sangya Deivedi Vs. The Additional Direction (Madhyamik Shiksha) U.P. Allahabad and others had already been dismissed as not pressed as the petitioner showed his inclination to pursue the departmental remedy. The instant writ petition has been filed with the same relief immediately after making a representation, which cannot be said to be availing of statutory remedy.
Learned Counsel for the petitioner prays for and is granted 24 hours time to look into this aspect.
