Heard learned counsel for the applicant and learned A.G.A. for the State.

By means of this application under section 482 Cr.P.C. the applicant has made an innocuous prayer to expedite the pending Session Trial which is said to be pending since 1996 in the court of Special Sessions Judge SC/ST Act, Bahraich.

It is contended on behalf of the applicant that after closure of the prosecution evidence, the accused persons were examined under section 313 Cr.P.C. and thereafter they were given opportunity to give evidence in defence. The submission on behalf of the applicant is that the Session Trial is going on for defence evidence for last about one and half years but till now the defence evidence has not been concluded. The accused persons are continuously seeking adjournment for defence evidence.

Learned A.G.A. has no objection in case a direction for expeditious disposal of the trial is issued to the court concerned.

In view of the above, this application under section 482 Cr.P.C. is finally disposed with the direction that the learned Sessions Judge before whom the Session Trial No.13 of 1996 is pending, shall expedite the final disposal of the trial and make every endeavour to decide the trial finally preferably within a period of three months from the date a certified copy of this order is produced before it.
