Petitioner has challenged the impugned order inter-alia on the ground that the order is contrary to the provisions of the Uttar Pradesh Land Acquisition (Revenue Department)Ministerial Service Rules, 1993 which will show that the appointing authority of the Clerk is District Magistrate concerned and not the Board of Revenue as averred in the impugned order.Secondly; it is wrong to say that the petitioner was temporary employee as from the own document of the department, it is established that the petitioner was confirmed on the post of Clerk on 15.3.1990 much prior to his promotion on the post of Head Clerk.
List this case on 7.12.2015. Standing Counsel shall seek instructions with regard to Appointing Authority of the petitioner and the role of Board of Revenue in the matter of the petitioner.
