This is an application under Section 5 of Limitation Act for condonation of delay in filing second appeal. As per the office report, the appeal is barred by time only by 3 days. Heard learned counsel for the parties.
It has been submitted by the learned counsel for the appellant that due to calculation error of time of limitation the delay of 3days occurred. Learned counsel for the respondents has orally opposed the prayer for condonation of delay. Having heard learned counsel for the parties and keeping in view of the fact that the delay is only 3 days. Application is allowed.
