In pursuance of the order dated 26.10.2015 Sri Jitendra Pratap Singh, Chairman, District Co-Operative Bank Ltd. Bahraich is present.
An application along with affidavit along with Vakalatnama of new counsel Sri Neeraj Chaurasiya on behalf of opposite party nos. 1 & 2 tendering apology has been filed regretting the non presence of counsel on behalf of opposite parties on 26.10.2015.
It has also been mentioned in the said affidavit that Counter Affidavit has also been filed in the year 1994.
Learned Counsel for the petitioner after seeing the record of the Court submitted that it appears that the same has been received by his earlier Clerk, who is no more. Since he does not possess the copy of the Counter Affidavit filed by the opposite parties, therefore, learned Counsel for the opposite party be directed to supply the copy of the Counter Affidavit.
Appreciating the submission of learned Counsel for the parties and the apology tendered by the Chairman, District Co-Operative Bank Ltd. Bahraich for non presence of the counsel on behalf of the Cooperative Bank Ltd. Bahraich, his appearance is exempted for future dates.
Learned Counsel for the opposite parties have already served the copy of the Counter Affidavit filed earlier,Sri Q. Ahmad, learned Counsel for the petitioner prays for and is granted two weeks? time for filing Rejoinder Affidavit.
