(C.M.Application No. 9649 0f 2006) Sri Devendra Mohan Shukla, learned Counsel for the petitioner raised an objection against the recall application moved by U.P. Pollution Control Board on the ground that the order in question has been passed after appreciating the pleadings of the opposite parties, therefore, only review application is maintainable.
Sri Ashok Kumar Verma, learned Counsel for the applicant submitted that present application may disposed of with liberty to file review application.
Appreciating the submission of the learned Counsel for the parties, application is rejected.
It is open for the opposite parties to file review application, if so advised.
