In the facts and circumstances of the case, we are of the considered opinion that the petitioner must respond to the notice issued under Section 3(1) of the Uttar Pradesh Control of Goondas Act, 1970 at the first instance.
We direct the District Magistrate, Bijnor to examine all aspects of the matter and to pass a reasoned order after considering the reply.
No case for quashing the notice is made out.
The writ petition is disposed of.
