Heard learned counsel for the parties.
Petitioner seeks quashing of FIR dated 8.1.2015 being Case Crime No. 23 of 2015 under Section 135 of the Indian Electricity Act (Amended), 2003, Police Station Indrapuram, District Ghaziabad.
Sri Rakesh Pande, learned counsel for the petitioner submitted that on reading of the FIR, it is admitted that one Sri Ram Manohar Singh (respondent no.4) was actually found involved in unauthorised use of electricity and no criminal liability can be imposed upon the owner of the property.
It is admitted that the owner of the premise in question has obtained electricity connection for domestic purposes only.
If the owner knowingly and willingly permitted somebody to use the electricity for commercial purposes through the said connection, he cannot evade his liability.
We see no good ground to quash the FIR.
The writ petition is accordingly dismissed.
