Heard learned counsel for the petitioners and the learned A.G.A.
Petitioners seek quashing of the F.I.R. dated 9.6.2015 being Case Crime No.113 of 2015, under Sections 498A, 323, 504, 506, 307 I.P.C. and under Section 3/4 D.P. Act, Police Station Bilariyaganj, District Azamgarh.
We have examined the First Information Report. It does disclose a cognizable offence. No case for quashing of the First Information Report is made out. The prayer in that regard is rejected.
However, it is provided that petitioner no.1(husband) shall surrender and apply for bail.
However, in the facts of the case, we provide that the petitioners no. 2 to 8 shall not be arrested in the above mentioned case, till submission of the police report.
With the aforesaid observations/direction, the present writ petition is finally disposed of.
