There is nothing on record to establish that any essentiality certificate has been issued by the Chief Medical Officer in respect of the medical claims submitted by Sri Mata Prasad Gupta prior to his death as claimed` by the petitioner for his treatment before 2010.
If the essentiality certificate has not been issued by the Chief Medical Officer, therefore, cannot be a mandamus to ensure payment/reimbursement of such medical bills.
The wit petition is dismissed.
