Heard learned counsel for the parties and perused the record.
It is not disputed that the petitioner has earlier moved an application for recall of order dated 2.5.2014 dismissing the writ petition for non prosecution and restoration of the case on 28.5.2014, which was within time, but there was some defect in the said application i.e. wrong number of case, therefore, the same was connected with some other case. After removing the said defect in the application, the applicants have moved the application for condonation of delay in filing the application for recall of the said order and restoration of the case to its original number. The objection on behalf of respondents 2 to 5 against the said application has been filed. We have gone through the affidavits filed in support of the application for condonation of delay as well as application for recall of the said order and restoration of the case to its original number. Reasons mentioned in the affidavits are satisfactory. Delay condoned. Application for condonation of delay in filing the recall application is allowed. The order dated 2.5.2014 passed by this Court is recalled. The application for recall of the said order is allowed and the writ petition is restored to its original number.
