Heard learned counsel for the parties.
The petitioner before this Court seeks a writ of mandamus commanding the Senior Superintendent of Police, Jhansi (respondent no.2) to provide protection to life and liberty of the petitioner and his family members till the disposal of Session Trial No. 224 of 2014 and further to take appropriate action against the accused Jabbar, Anis, and Raj Mohammad.
So far as prayer no. 2 is concerned none of the named persons have been made a party to the present writ petition. Therefore, prayer no.2 cannot be granted as they are necessary party.
So far as prayer no.1 is concerned, in the facts of the case, we provide that petitioner may approach the Senior Superintendent of Police, Jhansi, who shall do the needful to protect the life and liberty of the petitioner. If the trial for the murder of the brother and father of the petitioner, he may make an application before the Trial Court for protection, the Court shall take appropriate steps for the protection of the witnesses.
The writ petitioner is disposed of.
