Heard learned counsel for the parties and perused the record.
The petitioner with reference to the Government Order dated 4.3.2014 submits that his application for free hold rights, is liable to be considered. For the Purpose, the petitioner has placed reliance upon the sale deed, enclosed as Annexure -1 to the writ petition qua the building said to have been constructed over the said Nazul land.
From a reading of the sale deed, we find that there is absolutely no transfer of the Nazul land in favour of the petitioner. Only shops i.e. the Malwa which has been raised on the Nazul land had been sold.
In our opinion, such a sale deed confers no right to claim free hold rights over the Nazul land in terms of Government Order dated 4.3.2014. For the said reasons, no mandamus as prayed for need be issued.
The writ petition is dismissed.
