Submission is that Sufficient grounds have been brought on record to set aside the order of the trial court to proceed ex-parte against the defendant petitioner, yet the application has been rejected, which has occasioned failure of justice to the defendant petitioner.

Matter requires consideration.

Issue notice to respondent nos.3 to 9. Apart from normal mode of service, petitioner shall also take steps for service of notice by registered post, within a week. Office shall issue notice returnable at an early date. The respondents may file counter affidavit within four weeks. Petitioner will have two weeks thereafter to file rejoinder affidavit.

List thereafter.

Prayer for grant of interim relief would be considered on the next date of listing.
