Challenging the recovery certificate dated 17.12.2014 , the contention of the learned counsel for the petitioner is that he has taken a loan under the Prime Minister's Employment Generation Programme with the object to generate employment opportunities in rural and ubran areas.He submits that loan taken under Prime Minister's Employment Generation Programme is a commercial transaction under a State sponsered scheme for which proceedings under U.P.Agricultural Credit Act, 1973 could not have been undertaken .
Learned counsel for the respondent-bank prays for and is allowed four weeks' time to file counter affidavit.
Two weeks thereafter for filing rejoinder affidavit.
List on 8th July 2015.
Until further order of this court, the recovery citation dated 17.12.2014 shall remain stayed.
