Heard learned counsel for the parties.
The applicant seeks release of goods seized by the order dated 3.12.1998 passed in Case No. 30 of 1982, Special Appeal No. 169 of 1997, State Vs. Digambar and others, under Sections 396, 412 I.P.C., Police Station Achhalda, District Etawah, the accused persons filed a Criminal Appeal No. 2710 of 1998 (Digambar and others Vs. State of U.P.) , which is pending before this Court.
The court below has rejected the application vide order dated 23.2.2015 noting therein that the application can be made before the appellate court.
After hearing the learned counsel for the parties and after perusing the averments made in the present application, the Court is not inclined to interfere in the impugned order passed by the court below.
The application is accordingly dismissed.
