Submission is that the delay of about ten months in filing the substitution application had been adequately explained and contrary view taken by the court below is perverse and has occasioned failure of justice for the petitioner.

Respondents may file counter affidavit within six weeks. Rejoinder affidavit may be filed within two weeks thereafter.
