Heard Sri Sacchidanand Advocate holding brief of Sri Ravi Dingar, learned counsel for the petitioner and learned A.G.A. for the State of U.P.
Counsel for the petitioner has submitted that one Vijay Kumar aged 25 years, son of Sri Jagdish Pal, resident of Khemkaran, Amritsar who was living at Ambarpurva, P.S. Bheera, District Lakimpur Kheri and was working as domestic fellow, went near the Sharda river for grazing the animals but did not return back. He was missing on 02.05.2015, later on his dead-body was found on 04.05.2015 in the river. The petitioner has alleged that despite the evidence available with him, the police has not investigated the case fairly. He has annexed the photocopies of the of the dead-body which prima facie, force the Court to get the matter investigated all over again.
Since the allegations have been levelled against the Police of P.S. Bheera, the petitioner is directed to approach the D.I.G. concerned along with evidence within ten days from today.
The writ petition is disposed of with the directions to the D.I.G. concerned to look into the matter on receiving the application along with the evidence personally and shall ensure that investigation is conducted with due diligence and with all fairness.
