HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 39 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 19359 of 2015 Applicant :- Sonu @ Sohanveer Opposite Party :- State Of U.P. Counsel for Applicant :- V.N. Mishra Counsel for Opposite Party :- Govt. Advocate Hon'ble Ramesh Sinha,J.
Heard Sri V.N.Mishra, learned counsel for the applicant, Sri Radhey Shyam, learned counsel for the complainant, learned AGA for the State and perused the record.
It has been submitted by learned counsel for the applicant that the applicant has been falsely implicated in the present case. The allegation levelled against the applicant is false one as the deceased himself was a man of criminal antecedent and was done to death in some other mannerby other miscreants. He is in jail since 12.5.2014.
Learned AGA vehemently opposed the prayer for bail and submitted that as per para 27 of the affidavit, there appears to be nine criminal cases against the applicant which are cases of murder, dacoity, loot, robbery, attempt to murder etc. and charge sheet has been submitted against him only.
Without expressing any opinion on the merits and looking to the nature of the criminal antecedents of the applicant, I find that no good ground is made out for enlarging the applicant on bail.
The bail application of the applicant Sonu @ Sohanveer, involved in S.T. No. 809 of 2014 arising out of Case Crime no.1830 of 2013, under Sections 302, 201, 394, 120B I.P.C., P.S.-Loni, District Ghaziabad is, accordingly, rejected.
However, the trial court is directed to expedite the trial and conclude the same preferably within the period of eight months from the date of production of the certified copy of this order before the trial court, if there is no legal impediment.
