Learned counsel for the petitioners contends that the power to cancel the Patta granted under the proceedings of Ceiling Act stands conferred on the Commissioner of the Division, whereas in the fact of the present case the Additional District Magistrate, Padrona has proceeded to recall the order of 9th October, 2014 by which the patta had been granted in favour of the petitioner.
Matter requires consideration.
Let the learned Standing Counsel appearing for the respondents 1, 2 and 3 and Sri Tariq Maqbool Khan who appears for the respondent No. 4, file their affidavits on this petition within a period of six weeks from today.
Post this matter on the expiry of the aforesaid period before the appropriate Court.
In the meanwhile and till the next date of listing, it is provided that the respondents 2 and 3 shall not take any further proceedings for creation of rights in and over the plots which had been granted on patta in favour of the petitioner as per the order dated 9th October, 2014.
