It is the case of the petitioners that his land holding has been utilized for the purposes of construction of the road without acquisition and without payment of compensation.

In our opinion, the grievance of the petitioners needs to be examined by the respondent no.3, District Magistrate at the first instance.

Accordingly, this writ petition is disposed of with liberty to the petitioner to file a representation for ventilating his grievances before respondent no.3, District Magistrate within four weeks along with a certified copy of this order. If such representation is filed, respondent no.3 shall consider the same by means of a reasoned order preferably within eight weeks thereafter.

All consequential actions shall be taken accordingly.

It is made clear that no person can dispossess of his land without compensation.
