Heard learned counsel for the parties.
The petitioner seeks quashing of the order impugned dated 11.5.1982 passed by the respondent no.3-City Magistrate, Breilly and to restrain the respondents from interefering in the peaceful possession over the shop in question.
In view of the judgment of the Apex Court in the case of Union of India and anr. Vs. Raja Mohammed Amir Mohammad Khan, Civil Appeal No. 2501 of 2002, the proper remedy in the facts of the case for the petitioner/his successor's interest is to approach the Central Government.
The writ petition is dismissed with liberty to the petitioner to approach the Central Government.
