Heard learned counsel for the parties.

The petitioner seeks a writ of mandamus commanding the respondents not to construct  Manyawar Kanshi Ram Rural Chetana Bhawan, Dr. Ambedkar Rural Public Library Bhawan nor to raise the colony for poor and landless persons over the land of the petitioner in village Brahmanpur, Pargana Kerakat, Tehsil Kerakat, District Jaunpur and not to eject, dispossess, obstruct and interfere with the peaceful occupation and possession of the petitioner over his agricultural land. It is stated that land has been acquired without compensation being paid.

The writ petition is pending since 2008, even counter affidavit has not been called for. 

In the facts and circumstances of the case, we are of the considered opinion that the petitioner may be asked to approach the respondent no.2, District Magistrate at the first instance.

Accordingly, this writ petition is disposed of with liberty to the petitioner to file a representation for ventilating her grievances before respondent no.2 within two weeks along with a certified copy of this order. If such representation is filed, respondent no.2 shall consider the same by means of a reasoned order preferably within eight weeks thereafter. All consequential actions shall be taken accordingly.
