Vide order dated 11.11.2014, a costs of Rs. 10,000/- was imposed upon the respondents for not filing counter affidavit despite reasonable opportunity.
Now, the petitioner has moved an application giving explanation and cause of delay in filing the counter affidavit.
As the cause shown is sufficient, the order dated 11.11.2014 so far as it relates to deposit of cost is recalled.
Counsel for the petitioner submits that there is extreme urgency in the matter as the respondents have issued last call for joining training.
Considering the facts and circumstances, list this case on 12.1.2016 for hearing.
In the meantime, respondents shall not cancel the candidature of the petitioners for joining training for the post of Assistant Station Master.
