Heard learned counsel for the parties.
It is the case of the petitioners that in view of the order passed by Additional Commissioner (Judicial), Moradabad, Mandal Moradabad dated 6.3.1991 and the order passed by the Board of Revenue, Allahabad dated 5.9.1992, they are bhoomidhars of the Plot No. 127 Area 8 Bigha, 16 Biswa and 15 Biswansi, situated in village-Samsabad, Pargana-Nathor, Tehsil-Dhampur, District Binor. Private respondents no. 4 to 13 have created third party rights in respect of the land. Therefore, a writ of mandamus be issued directing the respondent no. 2 (Sub-Registrar) to consider the objection of the petitioners before the execution of the sale deed.
More than seven years have lapsed their filing of the present writ petition. In our opinion, cause does not survive any further.
The writ petition is dismissed as infructuous.
