Heard learned counsel for the parties.
There are four accused in the present appeal. Three were granted bail by the High Court. The order granting bail to co-accused Moni @Mohd. Ahmad was subjected to challenge before the Apex Court by filing Criminal Appeal No. 91 of 2015. The Apex Court set aside the order of the High Court granting bail and directed that the High Court shall decide the appeal as far as possible within one year from the date of receipt of the order. The period of one year is to expire on 14th January, 2016.
Learned Counsel for the appellant prays for adjournment.
Learned Counsel for the informant opposes the prayer on the ground that two of the accused have been granted bail and it is for their benefit that the adjournment is prayed.
We may not enter into any of the issues raised. Having heard the directions issued by the Apex court, we provide that the appeal shall be listed for hearing before the appropriate Bench in the week commencing 11th January, 2016. No adjournment shall be granted on any of the ground whatsoever on the next date.
