The instant writ petition has been wrongly filed by the petitioner before this Court challenging the impugned F.I.R. dated 1.12.2015, which was initially registered under section 302 I.P.C. During the course of the investigation the Investigating Officer has converted the offence from section 302 to 306 I.P.C. The maximum sentence prescribed for offence under section 306 I.P.C. is ten years, hence this matter be placed before appropriate Bench on 8.12.2015.
