Heard learned counsel for the applicant and Sri Satendra Kumar Singh holding brief of Sri Chandra Prakash Misra, learned counsel appearing for the respondent.
The plaintiff-applicant has approached this Court assailing the orders passed by the courts below, whereby the trial court has recalled its earlier order passed under Order 22 Rule 10 CPC for spot inspection by an Amin Commissioner being exparte order, by the impugned order, fresh direction has been issued for spot inspection.
The order being purely interlocutory in nature, this Court is not inclined to interfere with the impugned orders at this stage.
The petition being devoid of merit is accordingly dismissed.
No order as to costs.
