Proceedings, under Sections 12(1)B and 13 of Hindu Marriage Act, have been initiated by the applicant in 2008, and a prayer has been made to direct the court concerned to expedite the proceedings.
This Court finds that there is no unusual delay on part of the court concerned in adjudication of the matter, which may justify issuance of any direction by this Court to expedite the proceedings, and consequently, the petition fails, and is consigned to records.
However, it goes without saying that the court concerned shall proceed with the Case No.735 of 2008 (Salabh Rastogi vs. Smt. Vidushi Rastogi) pending in the court of Additional Principal Judge, Family Court, Meerut without granting any unnecessary adjournment to either of the parties, keeping in view the provisions of Section 21B(2) of the Hindu Marriage Act.
